Our firm filed a lawsuit under the federal Fair Labor Standards Act on behalf of tipped employees, such as servers and bartenders, who worked at any one or more of the Party Fowl restaurants in Tennessee. The lawsuit seeks to recover unpaid wages and unlawfully kept tips, among other things.

In this case, “tipped employees” are workers paid less than the applicable statutory minimum wage, plus customer tips. For example, servers and bartenders paid less than $7.25 per hour.

The lawsuit alleges that:

  1. Party Fowl keeps a portion of its tipped employees’ customer tips to offset certain business costs. Specifically, the lawsuit alleges that Party Fowl keeps $1 of its tipped employees’ tips each time it pays employees through a software called “Kickfin.”
  2. Tipped employees are required to perform substantial amounts of non-tipped work (such as opening and closing “side work”) both before the restaurants are open to customers and after customers are no longer being served, while still being paid a sub-minimum, tipped hourly wage. Some examples of non-tip-producing work are janitorial/cleaning and stocking work performed before the restaurants were opened to customers—when no customer tips could be earned—and similar work performed after employees were done serving customers.
  3. Party Fowl failed to provide tipped employees with the required notice before taking a tip credit towards their minimum and overtime wage obligations.

We seek to recover the difference between the tipped hourly wage paid to these tipped employees and the full statutory minimum wage of $7.25 per hour for all hours worked up to 40 hours in a workweek (and the full statutory minimum overtime wage of $10.88 per hour for all overtime hours worked in a workweek). We also seek to recover the tip money kept by Party Fowl, among other things.
