Our firm filed a lawsuit under the federal Fair Labor Standards Act on behalf of tipped employees (such as servers and bartenders) who worked at Blanco Cocina + Cantina in Nashville, Tennessee at any time since September 16, 2023. The lawsuit seeks to recover unpaid wages and unlawfully kept tips, among other things.
In this case, “tipped employees” are workers paid less than the applicable statutory minimum wage, plus customer tips. For example, servers and bartenders paid less than $7.25 per hour.
The lawsuit alleges that:
- Tipped employees are required to to share their hard-earned tip money with back-of-house employees who had no interaction with customers, like juicers.
- Tipped employees are required to perform substantial amounts of non-tipped work (such as opening and closing “side work”) both before the restaurant is open to customers and after customers are no longer being served, while still being paid a sub-minimum, tipped hourly wage. Some examples of non-tip-producing work are janitorial/cleaning and stocking work performed before the restaurant is opened to customers—when no customer tips could be earned—and similar work performed after employees were done serving customers.
- Blanco Cocina + Cantina failed to provide tipped employees with the required notice before taking a tip credit towards their minimum and overtime wage obligations.
We seek to recover the difference between the tipped hourly wage paid to these tipped employees and the full statutory minimum wage of $7.25 per hour for all hours worked up to 40 hours in a workweek (and the full statutory minimum overtime wage of $10.88 per hour for all overtime hours worked in a workweek). We also seek to recover the tip money Blanco Cocina + Cantina used to subsidize the wages of their juicers, among other things.
