Our law firm, along with Winebrake & Santillo, LLC, filed a lawsuit under the federal Fair Labor Standards Act (“FLSA”) on behalf of skycaps who worked for AMB Industries Incorporated and ABM Aviation, Inc. (“AMB”). Skycaps provide baggage services and passenger support to airline passengers.
The lawsuit alleges, among other things, that:
- ABM paid its skycap employees less than the statutory minimum wage of $7.25 per hour, plus customer tips, pursuant to the tip-credit provision of the FLSA; and
- ABM failed to provide skycaps with the required notice before taking a tip credit towards their minimum and overtime wage obligations.
We seek to recover the difference between the tipped hourly wage paid to skycaps and the full statutory minimum wage of $7.25 per hour for all hours worked up to 40 hours in a workweek (and the full statutory minimum overtime wage of $10.88 per hour for all overtime hours worked in a workweek), among other things.
